DATA USE AGREEMENT

The datasets in this repository are intended to supplement the following publication:  Pandey PU, Hedari M, Hacihaliloglu I, Dardenne G, et al. Bone in ultrasound (BonUS): a systematic evaluation of bone segmentation methods on a multi-institution dataset. By downloading, accessing, or using this Bone in Ultrasound (BonUS) dataset (the "Dataset"), you (the "User") agree to be bound by the terms and conditions of this Data Use Agreement (the "Agreement").
1. Permitted Use
The Dataset is provided for non-commercial, academic, and research purposes only. Users are granted a non-exclusive, non-transferable license to use the Dataset for internal research and educational activities.
2. Restrictions
No Commercial Use: The User shall not use the Dataset, or any derivative works thereof, for any commercial purposes, including but not limited to the development of commercial software, diagnostic tools, or the sale of the data.
No Redistribution: The User shall not reshare, redistribute, publish, or otherwise make the Dataset available to third parties without express written permission from the original authors.
3. Mandatory Attribution
If the User uses this Dataset in any formal research, publication, or presentation, the User must cite the following original publication:

4. Derivative Works and AI Models
Derivatives: Any data derived from the Dataset (e.g., refined segmentation masks, augmented images) must be used in accordance with the "No Commercial Use" and "No Redistribution" clauses of this Agreement.
Model Training: Any machine learning or AI models trained using this Dataset may not be used for commercial purposes or sold without a separate licensing agreement from the authors. Publications involving such models must include the mandatory attribution cited in Section 4.
5. Test Data and Hidden Labels
The Dataset includes a subset of "Test" images for which segmentation masks are withheld. These masks remain the private property of the authors. The User agrees not to attempt to circumvent any security measures or solicit these private masks from the authors for unauthorized purposes.
6. Term and Termination
This license is effective until terminated. This license will terminate automatically without notice from the authors if the User fails to comply with any provision of this Agreement. Upon termination, the User must destroy all copies of the Dataset and any derivative works in their possession.
7. Disclaimer of Warranty &amp; Indemnification
Disclaimer: The Dataset is provided "as is" without warranty of any kind, express or implied. The authors and their respective institutions shall not be liable for any claims, damages, or other liabilities arising from the use of the Dataset.
Indemnification: The User agrees to indemnify, defend, and hold harmless the authors and their respective institutions from and against any and all claims, liabilities, or damages arising out of the User's use of the Dataset.</dcterms:rights></metadata>
